A4 YACHTS – LUXURY CHARTERS DUBAI

These Terms and Conditions (“Agreement”) govern the rental and use of luxury yachts operated by A4 YACHTS in Dubai. By booking a yacht, the Client agrees to abide by these terms.

BOOKING PLATFORM DICSLAIMER

Through our website, A4 YACHTS, along with our affiliate distribution partners, provides an online platform where various third-party service providers (including but not limited to yacht charters, car rentals, and cruise services) can advertise their services for reservation. Visitors to the website can browse, select, and book these services directly through our platform.
By making a reservation via A4 YACHTS, you are entering into a direct and legally binding contract with the service provider offering the specific service you choose to book. From the moment your reservation is made, A4 YACHTS acts solely as an intermediary, transmitting your booking details to the relevant service provider and sending you a confirmation email on their behalf.

1. BOOKING & PAYMENT


1.1. Reservation & Confirmation

All bookings are subject to availability and will only be confirmed upon receipt of payment. To secure a reservation, the Client must provide a 50% deposit in advance or make full payment for the rental. Failure to do so may result in the booking being released or rescheduled based on availability.

1.2. Payment Terms

Full payment for the yacht charter must be completed prior to departure. Accepted payment methods include online payments through our website, bank transfers, credit/debit cards, and cryptocurrency (if applicable). Any additional charges incurred during the trip, such as extra services or extended hours, must also be settled before the departure of the yacht.

1.3. Refund & Cancellation Policy

Cancellations made 72 hours before departure are eligible for a 80% refund. However, cancellations made within 72 hours of departure are non-refundable. In the event of bad weather or unforeseen circumstances that prevent the charter from taking place, A4 YACHTS will reschedule the trip or provide a refund at its discretion.

2. YACHT USAGE & RULES


2.1. General Conduct

All guests must comply with UAE maritime laws and safety regulations while on board. The captain has full authority over the vessel and its passengers, and he may terminate the trip at any time if safety is compromised. Any illegal activities, including but not limited to drug use and excessive alcohol consumption, are strictly prohibited. Failure to adhere to these rules may result in immediate termination of the charter without refund.

2.2. Routes & Destinations

The route and destination for each charter are predetermined by A4 YACHTS to ensure a seamless and enjoyable experience. However, the Client may request modifications to the route during the trip, subject to the Captain’s approval and operational feasibility. Any changes must be within the allotted charter duration and comply with maritime safety regulations. The Captain has the final authority to accept or deny route changes based on weather conditions, navigation safety, and time constraints. Additional fees may apply for extended routes or extra hours beyond the original booking.

2.3. Guest Capacity

Each yacht has a designated maximum guest capacity as specified in its description. This limit must be strictly adhered to in compliance with maritime safety regulations. If the number of guests exceeds the allowed capacity, A4 YACHTS reserves the right to deny boarding to excess passengers before the trip begins or, if necessary, cancel the charter without a refund. It is the Client’s responsibility to confirm the guest count in advance to avoid any inconvenience.

2.4. Add-ons & Extras

Any additional services or extras requested by the Client, such as catering, water activities, entertainment, or extended charter hours, must be confirmed and fully settled before the trip begins. Failure to make the necessary payment before departure may result in the cancellation of the requested add-ons without refund, or the refusal to provide the service onboard.

3. LIABILITY & SAFETY


3.1. Safety Compliance

All yachts are equipped with life jackets and necessary safety equipment. Passengers must follow the captain’s instructions at all times to ensure a safe and enjoyable experience. Swimming is only permitted in designated areas and at the captain’s discretion.

3.2. Damages & Liability

The Client is responsible for any damages caused to the yacht, equipment, or onboard facilities by them or their guests. A security deposit may be required and will be refunded after inspection of the yacht at the end of the charter. A4 YACHTS is not liable for any injuries, accidents, or lost belongings during the trip.

4. FORCE MAJEURE

In the case of unforeseen circumstances such as adverse weather conditions, technical failures, government restrictions, or other events beyond the control of A4 YACHTS, the company reserves the right to reschedule, modify, or cancel the charter without liability. Refunds or alternative arrangements will be offered based on the situation.

5. GOVERNING LAW

These Terms and Conditions are governed by the laws of Dubai, United Arab Emirates. By proceeding with a booking, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.

Water Sports TERMS & CONDITIONS

By participating in any water sports activities provided by A4 YACHTS, including but not limited to wakeboarding, wakesurfing, jet skiing, paddleboarding, kayaking, and other water-related activities, the Client and all participants acknowledge and agree to the following terms:

1. Assumption of Risk

The Client understands and accepts that water sports activities involve inherent risks, including but not limited to falls, collisions, equipment failure, drowning, injuries from impact, and unpredictable weather or water conditions.

The Client voluntarily participates in these activities at their own risk and is solely responsible for their safety and well-being.

2. Release of Liability

A4 YACHTS, its owners, employees, crew members, affiliates, and partners shall not be held responsible for any injuries, accidents, losses, damages, or fatalities that may occur during or as a result of participating in water sports activities.

The Client waives any and all claims against A4 YACHTS for personal injury, property damage, or any other loss arising from their participation in water sports.

3. Medical Fitness & Responsibility

The Client confirms that they and all participants are physically fit, in good health, and have no medical conditions that may affect their ability to safely participate in water sports.

If a participant has any medical conditions, it is their responsibility to inform A4 YACHTS and obtain medical clearance before engaging in activities.

4. Mandatory Safety Compliance

Participants must follow all safety instructions provided by the crew, captain, and professional instructors.

Wearing a life jacket and other necessary safety gear is mandatory during water sports activities.

Failure to comply with safety guidelines may result in the termination of participation without refund.

5. Personal Responsibility for Equipment & Damage

The Client is responsible for using the provided equipment properly and safely. Any damages caused due to negligence or improper use will be charged to the Client.

6. Alcohol & Substance Use Policy

The Client must not be under the influence of alcohol or drugs while participating in water sports. A4 YACHTS reserves the right to deny participation to anyone deemed unfit or intoxicated for safety reasons.

7. Photography & Media Release

A4 YACHTS may take photos or videos during activities for promotional purposes. If the Client does not wish to appear in such media, they must notify us in advance.
